1. Agreement to Terms
This Software License Agreement and Terms of Service (the "Agreement") is a legal contract between you (the "Licensee") and AK TechnoSphere Comsoft (referred to as "ArktaCMS", "Company", "we", "us", or "our"). By downloading, installing, copying, or otherwise using the ArktaCMS software package (the "Software") or generating a license key from this portal, you unconditionally agree to be bound by these terms. If you do not agree to all terms, do not download, install, or use the Software.
2. Development Disclosures (AI-Assisted & Hand-Crafted Codebase)
ArktaCMS takes pride in delivering state-of-the-art web technology. The Software’s codebase represents a hybrid engineering model:
- Hybrid Engineering: The Software contains a combination of hand-crafted developer logic and advanced AI-assisted coding models. All code—whether generated or hand-written—has been rigorously audited, refactored, and tested to meet enterprise performance and security standards.
- User Consent: By agreeing to these terms, the Licensee acknowledges and accepts that the integration of AI-assisted and hand-crafted code carries no negative implications for code quality, licensing compliance, or functionality, and waives any claims relating to the use of AI assistant technologies in the development lifecycle.
3. License Grant, Scope & Domain Binding
Subject to compliance with this Agreement and payment of applicable fees, the Company grants the Licensee a non-exclusive, non-transferable, revocable license to install and run the Software:
- Single Domain Lock: Each standard license key is strictly locked to one (1) specific production domain name.
- Local Sandboxes: You are permitted to run the Software on local development environments (specifically
localhostand127.0.0.1) without limits or additional key requirements. - Redistribution Block: You may not sell, lease, sublicense, distribute, or assign the Software or individual license keys to third parties without prior written consent from the Company.
4. Automated Verification & Remote Access Controls
The Software is built with an automated cryptographic check mechanism.
- Verification Calls: The Software makes server-to-server validation queries to our central server (
/api/license/verify) in the background. These calls verify signature status and domain locks. - Administrative Lock: If a license key is deleted, modified, spoofed, or revoked in our portal database (e.g., due to refund requests or terms violations), the administrative dashboard will render a lock screen. The core website visitor templates will remain active, but console updates will be blocked until a valid key is provided.
5. Intellectual Property Rights
ArktaCMS owns and retains all rights, title, and interest in and to the Software, including all copyrights, patents, trade secrets, trademarks, and other intellectual property rights. The visual layout composition engines, custom dynamic forms database bindings, and shortcode parser modules are proprietary software assets.
6. Warranty Disclaimer & Capped Liability
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL THE COMPANY'S LIABILITY EXCEED THE TOTAL LICENSE FEES ACTUALLY PAID BY THE LICENSEE FOR THE SOFTWARE KEY.
7. Pricing, Fees & Refund Policy (Free of Charge Warning)
Currently, ArktaCMS and all generated license keys are distributed 100% free of charge. We do not demand payments, subscriptions, or credit card details from any user to install, unlock, or run the Software.
⚠️ WARNING: If any website, developer, or third-party asks you for payment to download, unlock, or use ArktaCMS, DO NOT make any payment. Please report it immediately and write back to us at support@aktscs.com with transaction details so we can take legal action.
8. Support, Maintenance & Custom Development
ArktaCMS provides clear separation between standard product support and bespoke development services:
- Free Installation Support: We offer complimentary, one-time standard installation assistance to help you deploy ArktaCMS on your target production host.
- Paid Customization Services: Any requests for custom feature development, visual design modifications, custom script integrations, or structural adjustments beyond the core product's features will be billed separately. Customization quotes are calculated case-by-case based on development hours and complexity requirements.
9. Modifications and Governing Law
We reserve the right to modify these terms at any time. These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any legal actions or proceedings arising under this agreement shall be brought exclusively in the competent courts located in India.
